Certify Teacher TM Privacy Policy

Simulados Software, Inc., recognizes the importance of protecting the privacy of your personal information, and we have prepared this Privacy Policy to provide you with important information about privacy practices for Certifyteacher.com. This Privacy Policy applies when you use any website, mobile, or tablet application or other online service that references this Privacy Policy (collectively, the “Services”).
This Privacy Policy explains what personal data we collect as part of the Services and the purpose for that collection. We also explain how we use your personal data and your choices about that use. By visiting the Services or submitting your personal data, you consent to the practices described in this Privacy Policy.
Information We Collect
We may collect personal information about our users in various ways. For example, we may collect information that you provide to us, information that we collect through your use of the Services, and information that we collect from publicly available sources or third parties.
Information You Provide to Us. In order to take advantage of the Services or features offered or provided by the Services, you may be asked to provide personal information. If you are a job applicant seeking employment, we will also ask for information relevant to your employment application.

Online Tracking

Web Beacons and Other Tracking Technologies. We also may use other tracking technologies. For example, we may use technologies called beacons (or “pixels”) that communicate information from your device to a server. Beacons can be embedded in online content, videos, and emails, and can allow a server to read certain types of information from your device, know when you have viewed particular content or a particular email message, determine the time and date on which you viewed the web beacon, and the IP address of your device. We use web beacons for a variety of purposes, including to analyze the use of our Services and in conjunction with cookies.
Do Not Track Signals. Some web browsers may transmit “do not track” signals to the websites and other online services with which a user communicates. There is no industry standard that governs what, if anything, websites should do when they receive these signals. We currently do not take action in response to these signals. If and when a standard is established and accepted, we may revisit our policy on responding to these signals.

We may update this Privacy Policy from time to time without prior notice to reflect changes in our information practices. Any changes to the Privacy Policy will become effective when posted. Certify Teacher’s study materials are protected by the laws of copyright of the United States and other countries throughout the world. Unauthorized reproduction of these materials, or portions thereof, in any form whatsoever, is strictly prohibited. Certify Teacher materials you have purchased are to be used for your own personal use and benefit. Unauthorized commercial resale of Certify Teacher materials is prohibited. Please be advised that Certify Teacher personnel regularly monitor various commercial online auction websites in order to prevent the unauthorized sale of Certify Teacher materials. Certify Teacher reserves all its rights in the event of a violation of this policy, which may include discontinuation of the auction itself, and enforcement of Certify Teacher’s rights under law and equity.
Creating, purchasing, and/or using photocopied (i.e., pirated, illicit copies) study notes and other preparatory materials violates the law and may violate Code of Ethics and Standards of Professional Conduct as set forth by the respective accrediting agencies. Shared use of product is prohibited. Certify Teacher will only support registered purchases of these products directly from Certify Teacher or from an authorized distributor. Certify Teacher’s products are intended for personal use only unless specifically approved in writing by Certify Teacher.
Certify Teacher practice exams, downloads, and eLearning are online learning services for various educator certification exams and are provided by Certify Teacher, subject to your acceptance and compliance with the terms and conditions set forth below. Sharing or selling Online Access is prohibited. All Online Access is non-transferable.
Please read this Agreement carefully before accessing or using your Online Access. By accessing or using online products or services, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use your Online Account. Certify Teacher may modify this Agreement at any time and such modifications shall be effective immediately upon posting of the modified Agreement. You agree to review the Agreement periodically to be aware of such modifications and your continued access or use of Online Access shall be deemed your conclusive acceptance of the modified Agreement.
Copyright and Licenses. The entire contents of www.certifyteacher.com and its online programs and services are copyrighted under the United States copyright laws. The owner of the copyright is Simulados Software, Inc. You may print and download portions of material from the different areas of www.certifyteacher.com solely for your own non-commercial use. Any Online Access via www.certifyteacher.com (trademark: CertifyTeacher™) is solely for your non-commercial use. Any other copying, redistribution, retransmission or publication of any downloaded or offline available material, is strictly prohibited without the express written consent of Simulados Software. You agree not to change or delete any proprietary notices from materials downloaded or emailed from Certify Teacher or Certify Teacher systems. You agree that you shall have no recourse against Certify Teacher for any alleged or actual infringement or misappropriation of any proprietary right in your communications to us. You agree not to change or edit your score report or certificate of completion upon delivery from Certify Teacher. Certify Teacher cannot authenticate a score report or certificate of completion unless it is sent directly from Certify Teacher systems. Any score report or certificate of completion sent from a user's email is not guaranteed to be accurate.
Use of Online Access via www.certifyteacher.com. You understand that Certify Teacher does not warrant that this Online Access will be uninterrupted or error-free. Online Access to www.certifyteacher.com is provided on an “as is, as available” basis. You agree to meet the minimum system requirements set forth for Certify Teacher’s electronic products, including and if applicable for your specific certification or exam preparation courses, Certify Teacher practice exams, downloads, and eLearning.
You understand that Certify Teacher may revise the content of its website and online products from time to time to meet its training objectives. It may add or remove materials that it considers as unnecessary or no longer relevant for exam preparation. Once the material is removed it will not be accessible and will not be available upon request.
You understand that your subscription to any Online Access is a limited license to use the content only for the access period, which is between the time access is granted and the access expiration date. You have access to the practice exams until you pass your state assessment or up to 3 years whichever comes first. Access to the study guides is set to 365 days. The subscription is non-transferable and is to be used only by you. You will not share the username/user id and password with anyone, even if that person has his or her own subscription to Online Access. Such sharing of usernames/user ids and passwords is a violation of this Agreement and will result in immediate suspension of your privileges to any Online Access at www.certifyteacher.com without refund.
Certify Teacher monitors its website, including the use of Online Access, for visitors and enforces its one subscriber-one user policy diligently.
Certify Teacher reserves the right to access any online account (via password reset) without notice at any time for reasons that include: refunds/returns, exchanges, troubleshooting, data review, per a user's request or per an advisor, professor, coordinator, certification officer, or administrator at a college, university, alternative certification program or educator preparation program's request.
Certify Teacher will provide you feedback about your performance on the tests and exams in our electronic products, if applicable. This is intended to highlight areas of your strengths and weaknesses. You understand that the performance feedback is meant to assist you in your preparation for your specific exam and is in no way intended to act as a projection or a forecast of your actual exam score. The feedback is intended only as a diagnostic tool of your knowledge as you prepare for your specific exam, and your practice scores may be affected by factors beyond Certify Teacher’s control.
In no event will Certify Teacher be liable for (I) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use www.certifyteacher.com, or any information, or transactions provided on www.certifyteacher.com or downloaded or hyperlinked from www.certifyteacher.com, even if Certify Teacher or its authorized representatives have been advised of the possibility of such damages; or (II) any claim attributable to errors, omissions, or other inaccuracies in Certify Teacher’s electronic content and/or materials or information downloaded through, or hyperlinked from, www.certifyteacher.com. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such states, Certify Teacher’s liability is limited to the greatest extent permitted by law.
Indemnification. You agree to indemnify, defend, and hold harmless Simulados Software, Inc; Certify Teacher and their respective subsidiaries, officers, directors, employees, agents, licensors, suppliers, and any third party information providers to Certify Teacher’s Online Access from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by you.
Miscellaneous. This Agreement shall be interpreted and governed by the laws of the State of Texas without regard to the conflict of law provisions of such state, and any arbitration or legal action relating to this Agreement shall be brought in the appropriate forum located in North Harris County, Texas, which venue and jurisdiction you agree to submit to, and the prevailing party in any such action shall be entitled to recover reasonable attorneys’ fees and expenses as part of any judgment or award. The pursuit by Certify Teacher of any remedy to which it is entitled at any time shall not be deemed an election of remedies or waiver of the right to pursue any of the other remedies to which Certify Teacher may be entitled. This Agreement is the entire Agreement between you and Certify Teacher, and it supersedes any other communication, advertisement, or understanding with respect to its electronic products. If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect. All provisions of this Agreement relating to the disclaimers of warranties, limitation of liability, remedies, or damages, and Certify Teacher’s ownership of the electronic products and other proprietary rights shall survive any termination of this Agreement.
